General terms and conditions of sale

1. Definition of Terms and Conditions

These Terms and Conditions (the Conditions) regulate the sales relationships of the Products (as defined below) that can be purchased on the website (the Site) through the service (the Service) between the Owner of the Service and the User who uses the Service or purchase the Products on the Site.

2. Owner of the Service

The Owner of the Service is Habi Travel a rls (Owner or HabiTravel), with registered and administrative headquarters in Fiumicino, via Giovanni Durli 29, tax code and VAT number no. 16450451006, registered in the Rome company register at REA – RM - 1657478, share capital €1,900.00 Euro, contactable at the e-mail address info@habitravel.com

3. Products for sale

The Owner offers five types of Products for sale:

3.1 "Guided tours": these are tickets to be used for guided tours with meeting point in the place where the tours take place.

3.2 "Single-day guided tours with transport": these are tickets to be used for guided tours including transport by NCC, coach or train, without overnight stay.

3.3 "Multi-day trips with transport and overnight stay": these are tickets to be used for guided tours including transport by NCC, coach or train and inclusive of overnight stay.

3.4 "Cultural Connections": these are guided walking tours.

3.5 "Gift vouchers" to book and use the Products referred to in points 3.1, 3.2, 3.3 and 3.4.

3.6 "Transport" transport services

3.7 "Tickets" entrance tickets to exhibitions, museums, palaces, gardens and monuments

The types of Products referred to in points 3.1, 3.2, 3.3 and 3.4 include a guided tour and any entrance tickets to exhibitions, museums, palaces, gardens and monuments, unless explicitly mentioned on the ticket purchase page.

4. Product purchase procedure

The description of the Products (3.1, 3.2, 3.3 and 3.4) contains the title of the guided tour, the description of the guided tour, information relating to the meeting time and place, the description of what is included in the package offered and the box for the purchase, with the relative price expressed in Euros. To start a purchase order for one or more Products, the User must click on the "Book now" or "Buy now" button (or equivalent) and follow the guided procedure for completing the order form, which must be considered as a contractual proposal between the Owner and the User. The page with the description of the Products referred to in point 3.5 contains the information for the purchase and use of the Gift Vouchers, and the related purchase box.

To complete the order form, the User must provide personal data and payment details, which will be processed in accordance with what is stated in the Site's Privacy Policy.

During the purchase procedure, the User is asked to accept these Terms and Conditions, which can be found through a link present during the purchase procedure itself: acceptance is necessary to complete the purchase procedure.

5. Payment methods

The sending of the order form is declared concluded and the purchase of the relevant Products confirmed only upon receipt of the confirmation e-mail containing the summary of the order form by the Owner. The Owner's confirmation email (printed or on a smartphone) must be shown to the guide before the start of the guided tour (in case of purchase of Products referred to in points 3.1, 3.2 or 3.3). No access pass or ticket will be sent to the User's physical address.

To process payments, neither the Site nor the Service comes into contact in any way with the details of the credit card used or the Paypal/Stripe account (such as credit card number, cardholder name, validity date and password), which are managed directly and respectively, by the credit card issuer and by Paypal/Stripe itself. If these third-party tools refuse payment authorization, the order form will not be completed, therefore the Products in the shopping cart are not to be considered purchased and confirmed.

 

6. Withdrawal and refund

If the User has purchased one or more Products that do not conform to his/her needs, he/she can make a request for withdrawal or modification of the booking date and/or time (cancellation, modification of the purchase or modification of the booking date and/or time) to the contact details indicated on the confirmation email, reporting the purchase order references. The User is entitled to a voucher that can be spent within 3 months through the Service for the purchase of any Product. The value of the voucher is calculated starting from the amount of the Product for which the withdrawal or modification of the date and/or time was requested, deducting any cancellation costs according to the following methods (unless otherwise indicated on the business’s web page for the activity being booked/purchased):

 

6.1 For the Products referred to in point 3.1 "Guided Tours" and in point 3.4 "Cultural Connections":

 

  • if the request for withdrawal or modification of the booking date and/or time is received at least 72 hours before the start time of the guided tour (or Cultural Connection), there is no cancellation cost (issuance of a voucher of equal value 100% of the price of the Product purchased).

 

  • if the request for withdrawal or modification of the booking date and/or time is received between 72 hours and 24 hours before the start time of the guided tour (or Cultural Connection), there is a cancellation cost of 50% of the price of the Product for which the withdrawal was requested (issuance of a voucher with a value equal to 50% of the price of the Product purchased).

 

  • if the request for withdrawal or modification of the booking date and/or time is received within 24 hours prior to the date of the guided tour (or Cultural Connection), there is a cancellation cost of 100% of the price of the Product for which the withdrawal was requested (no voucher).

6.2 For the Products referred to in point 3.2 "Same day guided tours with transport":

 

  • if the request for withdrawal or modification of the booking date and/or time is received at least 30 days before the start of the guided tour, there is no cancellation cost (issuance of a voucher with a value equal to 100% of the price of the Product purchased).

 

  • if the request for withdrawal or modification of the booking date and/or time is received between 29 and 15 days before the start of the guided tour, there is a cancellation cost of 50% of the price of the Product for which the withdrawal was requested (issuance of a voucher with a value equal to 50% of the price of the Product purchased).

 

  • if the request for withdrawal or modification of the booking date and/or time is received within 14 days prior to the date of the guided tour, there will be a cancellation cost of 100% of the price of the Product for which the withdrawal was requested ( no voucher).

 

6.3 For the Products referred to in point 3.3 "Multi-day trips with transport and overnight stay":

 

    • if the request for withdrawal or modification of the booking date and/or time is received at least 60 days before the start of the trip, there is no cancellation cost (issuance of a voucher with a value equal to 100% of the price of the Product purchased).
    • if the request for withdrawal or modification of the booking date and/or time is received between 59 and 30 days before the start of the trip, there will be a cancellation cost of 50% of the price of the Product for which the cancellation was requested (issuance of a voucher with a value equal to 50% of the price of the Product purchased).
    • if the request for withdrawal or modification of the booking date and/or time is received within 29 days prior to the travel date, there is a cancellation cost of 100% of the price of the Product for which the withdrawal was requested (no voucher).

 

For the Products referred to in points 3.1, 3.2, 3.3 and 3.4, no voucher is due if the request for withdrawal or modification of the booking date and/or time is received on the same day as the guided tour (or trip) or in the following days, nor in case of failure or non-punctual presentation on the day, time and meeting place indicated in the purchase confirmation email, nor due to impossibility of accessing a museum or other place of culture.

 

The Products referred to in point 3.5 "Gift vouchers" are refunded exclusively if the withdrawal request is received within 14 days from the date of purchase. The Gift Vouchers defined in point 3.5 must be used within one year of purchase. The validity of an expired gift voucher (not more than 12 months ago) can be extended at a cost of 10.00 euros for each month of extension, by making an extension request to the contact details indicated on the confirmation email and/or on the gift voucher itself.

 

7. Cancellation of guided tours

The guided tours relating to the Products referred to in points 3.1, 3.2, 3.3 and 3.4 may be subject to cancellation by unilateral decision of the Owner, also due to particularly adverse weather conditions or causes of force majeure. All Users who have purchased a canceled guided tour will be promptly informed via e-mail and/or telephone and will be entitled to a full refund (with reimbursement to the credit card or Paypal-Stripe account used for the purchase) of the guided tour or, at the User's choice, to a voucher with a value equal to 100% of the cost of the Product purchased, which can be spent within 6 months on the Site for the purchase of any Product.

 

Should the cancellation due to force majeure be regulated by legislative decrees, extraordinary regional and/or municipal ordinances, the reimbursement methods will follow the instructions prescribed therein.

 

During the refund procedures, the Owner does not come into contact in any way with the details of the credit card (or Paypal/Stripe account) which are managed directly and respectively, by the credit card issuer and by Paypal/Stripe itself .

 

8. Copyright

All trademarks, figurative or nominative and all other signs, trade names, service marks, word marks, commercial names, illustrations, images and logos appearing on the Site relating to HabiTravel are and remain the exclusive property of the Owner or its licensors and are protected by current trademark laws and related international treaties. All contents of the Products referred to in points 3.1, 3.2, 3.3 and 3.4 are the exclusive property of the Owner or its licensors and are protected by current copyright laws (Law 633/1941) and the relevant international treaties.

9. Processing of personal data

Information regarding the processing of the User's personal data is reported on the page containing the Site's Privacy Policy.

10. Changes

The Owner reserves the right to modify or update these Terms and Conditions also as a result of the introduction of new laws or regulations. The updated Terms and Conditions are effective from the date of publication shown at the bottom of these Terms and Conditions. Users of the Service are required to periodically check these General Terms and Conditions of Sale to ascertain any changes that have occurred since the last consultation. In any case, use of the Service implies acceptance of the changes that have occurred in the meantime.

 

11. Applicable law and Jurisdiction

These Terms and Conditions are subject to Italian law and in particular to Legislative Decree no. 206/2005 relating to distance selling and Legislative Decree no. 206/2005 relating to some aspects of electronic sales. For any dispute that may arise from the use of the Service or from the purchase of the Products or for the execution of the contract with the User, the Court of Rome will have exclusive jurisdiction.

 

12. Online Dispute Resolution

In accordance with article 14 of Regulation (EU) no. 524/2013, the Owner informs Users that it is possible to resolve disputes with companies out of court arising from purchases of goods and services made online by connecting to the ODR telematic platform, reachable at https://webgate.ec.europa.eu/odr
